1. The agreement
These Terms of Service are an agreement between you and Proofsource AI Pvt Ltd, a company registered in India ("Proofsource", "we", "us"). They cover the Proofsource website at proofsource.co, the app at app.proofsource.co, and everything we provide through them (the "Service").
Proofsource is for businesses. If you use it for a company, you agree to these terms on that company's behalf and confirm you have authority to do so. "You" then means both you and that company. You must be at least 18. If you sign an order form or written quote with us, it forms part of this agreement and wins if it conflicts with these terms.
By creating an account or using the Service, you accept these terms and our Privacy Policy. If you don't accept them, don't use the Service.
2. The Service
Proofsource measures how AI answer engines such as ChatGPT, Claude, Perplexity and Google AI Overviews mention and cite your brand. It reports what it finds, alerts you to changes, suggests content fixes, can publish approved content to your website, and includes Ask Proof, an assistant that answers questions about your data. We may change the Service, including adding, changing or removing features.
3. Your account
- Give us accurate details and keep them up to date.
- Keep your sign-in secure. You are responsible for what happens under your account and in your workspace, including what your invited teammates do.
- Workspace owners control their workspace: who has access, which services are connected, and whether the workspace is deleted.
- Tell us straight away if you suspect someone has accessed your account without permission.
4. Free trial
The free trial gives you 2 free scans: each scan asks 25 questions on ChatGPT, Perplexity, Claude and Google AI Overviews. The first scan runs when you sign up and the second about a day later. Then scanning pauses. The trial needs no card and is never charged. There is one trial per company domain. After the trial, monitoring stays paused unless you move to a paid plan, and your workspace and answers stay so you can pick up where you left off. We may change or end the trial offer at any time, and we may refuse a trial we believe is being misused.
5. Paid plans, fees and cancellation
- Plans and prices are agreed with you before anything is charged, and set out in your checkout, order form or written quote.
- Payments are processed by Dodo Payments, our merchant of record. Dodo Payments charges you, issues your invoice and collects any sales tax, VAT or GST that applies. Its terms apply to the payment itself.
- Plans renew automatically for the same period, monthly or yearly, at the then-current price unless you cancel. We will give you reasonable notice before a price change takes effect on renewal.
- You can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- Fees are non-refundable, including for partial periods and unused capacity, except where the law requires a refund or we agree otherwise in writing.
- If a payment fails and is not fixed after reasonable notice, we may pause monitoring or suspend the account until it is paid.
6. Acceptable use
You agree not to:
- Use the Service to break the law, infringe anyone's rights, or publish unlawful, deceptive, defamatory or harmful content.
- Track brands, domains or accounts you have no legitimate business reason to analyse, or connect accounts you are not authorised to connect.
- Put personal data about other people, or sensitive data, into prompts, uploads or other content without a lawful basis.
- Use Proofsource to abuse, overload or manipulate AI engines, or to break their terms, for example by using our access to their services for purposes other than measuring your visibility.
- Scrape, crawl or bulk download the Service, or access it through automated means other than the features and APIs we provide.
- Resell, sublicense or share access to the Service, or use it to build a competing product.
- Reverse engineer, probe or bypass the Service's security, usage limits or access controls.
- Upload malware, or interfere with the Service or other customers' use of it.
7. Connected accounts and publishing
- When you connect a service such as Google Search Console, Google Analytics, Cloudflare, a CDN, a log drain, WordPress, Slack, Microsoft Teams or a webhook, you confirm you have the right to connect it and to let us use its data to provide the Service.
- You are responsible for content you publish through Proofsource, for example to WordPress. We publish only content you have approved. Review every draft before it goes live.
- Alerts go to the email addresses, channels and webhook URLs you choose. Make sure the right people receive them.
- Connected services are run by third parties under their own terms. We are not responsible for their availability, their changes, or what they do with data you send them.
- You can disconnect any service at any time on the Integrations page.
8. AI measurements and AI output
- Our measurements are samples. AI engines give different answers to the same question at different times, in different places and to different people. We report what the engines said when we asked, with the uncertainty that comes with sampling.
- Results describe AI behaviour at the time of measurement. They don't predict what engines will say later, and they are not a full record of every answer an engine gives.
- We don't control AI engines and are not affiliated with or endorsed by OpenAI, Anthropic, Perplexity, Google or any other engine provider. They may change, limit or stop their services at any time, and that can affect what we can measure.
- We don't guarantee any ranking, mention, citation, traffic or revenue outcome, including from content fixes we suggest.
- Answers we capture are third-party content. We don't verify or endorse what AI engines say.
- Content drafts, Ask Proof replies and other AI-generated output can be wrong or incomplete. Check it before you rely on it or publish it.
9. Your data and content
- You own your data and content: what you put into Proofsource, what you import from connected services, and the content drafts we create for you once you accept them.
- You give us permission to host, copy, process and display your data and content only as needed to provide, secure and support the Service for you.
- We don't use your data or content to train AI models.
- We may create aggregated, de-identified statistics from use of the Service, such as how often AI engines cite certain kinds of source. These statistics never identify you or your workspace.
- You are responsible for having the rights and permissions needed for the data and content you bring.
10. Our property
We own the Service, including our software, methods, scoring, report formats, designs and brand. These terms give you a right to use the Service while you are a customer, not ownership of it. If you send us feedback or ideas, we may use them without any obligation to you.
11. Confidentiality
Each of us may receive non-public information from the other, such as your workspace data or our pricing and product plans. Each of us will use the other's confidential information only for this agreement, protect it with reasonable care, and share it only with people and providers who need it and are bound to protect it. This does not cover information that is public, was already known, was independently developed, or must be disclosed by law. Where the law allows, we will give notice before such a disclosure.
12. Suspension and termination
- You can stop using the Service and close your workspace at any time.
- We may suspend or end your access if you materially breach these terms, fail to pay, use the Service in a way that risks harm to us, other customers or third parties, or if the law requires it. Where it is reasonable, we will warn you first and give you a chance to fix the problem.
- When your account ends, we will provide an export of your data on request, where reasonably possible. We then delete it as described in our Privacy Policy.
- Sections that by their nature should survive termination do so, including those on fees owed, ownership, confidentiality, disclaimers, liability, indemnity and governing law.
13. Disclaimers
We work hard to keep the Service accurate, secure and available. Even so, the Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties not stated in these terms, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise the Service will be uninterrupted or error-free.
14. Limitation of liability
- Neither of us is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data, even if told they were possible.
- Each party's total liability arising out of or relating to this agreement is limited to the fees you paid us in the 12 months before the event giving rise to the claim.
- These limits don't apply to your payment obligations, to your indemnity obligations, to breaches of section 6, or to liability that cannot be limited by law, such as for fraud.
15. Indemnity
You will defend and indemnify us against third-party claims arising from your data or content, content you publish through the Service, accounts you connect, or your breach of section 6. We will tell you promptly about any such claim and cooperate reasonably.
16. Governing law and disputes
These terms are governed by the laws of India. If a dispute arises, write to us at [email protected] and we will try in good faith to resolve it informally. If we can't, the courts at Bengaluru, Karnataka, India have exclusive jurisdiction, and each of us agrees to that jurisdiction. Either of us may seek urgent relief from any competent court to protect confidential information or intellectual property.
17. Changes to these terms
We may update these terms as the Service and the law change. We will post the new version here with a new effective date. If a change is material, we will give you reasonable notice by email or in the app before it takes effect, unless the law requires the change sooner. If you keep using the Service after a change takes effect, you accept it. If you don't accept it, you can cancel before it takes effect.
18. General
- These terms, the Privacy Policy and any order form are the whole agreement between us about the Service.
- You may not transfer this agreement without our written consent. We may transfer it as part of a merger, acquisition or sale of assets, with notice to you.
- Neither of us is responsible for delays or failures caused by events beyond reasonable control, including outages of AI engines, cloud providers or networks.
- If a part of these terms is unenforceable, the rest stays in force. Not enforcing a term is not a waiver of it.
- You must comply with export control and sanctions laws that apply to your use of the Service.
- We send notices to the email address on your account. Send legal notices to us at [email protected].
- Nothing in these terms creates a partnership, agency or employment relationship.
